Summary of decisions

The Management Board (MB) adopted:

  1. The minutes of the 52nd Management Board meeting of 25 January 2020

  2. DECISION n° 229  of the Management Board of the European Union Agency for Railways adopting an Opinion on the Annual Accounts 2019

    The budget of ERA for the year 2019 was established in compliance with the principles of unity, budget accuracy, annuality, equilibrium, unit of account, universality, specification, sound financial management and transparency as set out in the ERA Financial Regulation.

    The annual accounts 2019 of the Agency have been prepared in accordance with the Title IX of the Financial Regulation applicable to the general budget of the European Union and in accordance with the accounting rules, and the accounting principles and methods.

    The Management Board gave a positive opinion considering that the ERA accounts, taken as a whole, and drawn up under the responsibility of the Agency’s Executive Director, reflect the implementation of the Agency’s 2019 budget and the activities undertaken by it during this year.


  3. DECISION n° 230 of the Management Board of the European Union Agency for Railways adopting the consolidated annual activity report 2019

    According to article 51 § 1 point (a) of the new Agency Regulation, an annual report for the previous year should be adopted by the Management Board and sent to the European Parliament, the Council, the Commission and the Court of Auditors by 1 July each year and made publicly available.

    The main elements in the Consolidated Annual Activity Report for the year 2019 concern the provision of information on:

    • An overall reporting of the Agency’s main activities, outputs and achievements in 2018
    • Risk Management status
    • Internal Control Standards Assessment
    • Results of Audits of the European Court of Auditors and the Internal Audit Service
    • Follow up of reservations and action plans for audits from previous years

  4. DECISION n° 231 of the Management Board of the European Union Agency for Railways adopting the revision of the Management Board’s Rules of Procedure

    The Management Board updated its Rules of Procedure which were originally established in 2014 and amended in 2016.


  5. DECISION n° 232 of the Management Board of the European Union Agency for Railways adopting the working methods for Waiving Immunity

    The Management Board adopted the working methods regarding the context and actions envisaged to be taken by the MB when a request for waiving the immunity of its staff is submitted to the Agency.


  6. DECISION n° 233 of the Management Board of the European Union Agency for Railways amending the Single Programming Document 2020 (amendment n° 1)

    The Management Board amended the SPD 2020 in light of the impact of COVID-19 on the activities and the resources as well as the procurement plan.


  7. DECISION n° 234 of the Management Board of the European Union Agency for Railways amending MB Decision n°194 establishing procedures for decision-making by the Executive Director in relation to authorisations for placing vehicles on the market, single safety certificates, and ERTMS track-side approvals

    MB Decision n°194 (as amended by MB Decision n°219) currently establishes procedures for decision-making by the Executive Director in relation to authorisations for placing vehicles on the market, single safety certificates, and ERTMS track-side approvals.   The Management Board updated the decision to include:

    • Possibility to delegate Executive Director’s decisions requesting an applicant to submit an application for authorisation in case of a wrong categorisation or insufficiently substantiated information in accordance with Article 16(4) of Commission Implementing Regulation (EU) 2018/545 of 4 April 2018 establishing practical arrangements for the railway vehicle authorisation and railway vehicle type authorisation process pursuant to Directive (EU) 2016/797 of the European Parliament and of the Council (hereinafter referred to as “Regulation (EU) 2018/545”);
    • Possibility to delegate Executive Director’s opinions with regard to pre-engagement baselines to be issued in accordance with Article 24(2) of Regulation (EU) 2018/545.
