Operator of rail freight service facility

Operators of service facilities as defined in Article 3, point (12), of Directive 2012/34/EU, that provide services necessary for operating a freight rail transport service and whose service facilities are listed in point (2), subpoints (b), (c), (d) and (g), of Annex II to Directive 2012/34/EU and are connected to the trans-European transport network as specified in Annex II to Regulation (EU) 2024/1679, limited to the multimodal freight terminals identified pursuant to Article 36 of that Regulation. NOTE: - Article 3, point (12), of Directive 2012/34/EU: Operator of service facility means any public or private entity responsible for managing one or more service facilities or supplying one or more services to railway undertakings referred to in points 2 to 4 of Annex II; - Point (2), subpoints (b), (c), (d) and (g), of Annex II to Directive 2012/34/EU: Access, including track access, shall be given to the following services facilities, when they exist, and to the services supplied in these facilities: (b) freight terminals; (c) marshalling yards and train formation facilities, including shunting facilities; (d) storage sidings; (g) maritime and inland port facilities which are linked to rail activities. - Annex II to Regulation (EU) 2024/1679: List of nodes of the Trans-European Transport Network. - Article 36 of Regulation (EU) 2024/1679: Identification of the multimodal freight terminals 1. The multimodal freight terminals of the trans-European transport network are terminals that are open to all operators and users in a non-discriminatory way and are: (a) located in or adjacent to the maritime ports of the trans-European transport network, as listed in Annex II; (b) located in or adjacent to the inland ports of the trans-European transport network, as listed in Annex II; (c) located in the airports of the trans-European transport network, as listed in Annex II; or (d) classified as rail road terminals or terminals along the inland waterways of the trans-European transport network, as listed in Annex II.
