|Description: ||In accordance with Article 6(2) and 6(4) of Directive 2004/49/EC, and on the basis of the recommendation of the European Railway Agency, the Commission adopted the Regulation 402/2013 on the CSM for risk assessment that repeals Regulation 352/2009.

As an agreement on additional risk acceptance criteria (RAC) could not be reached among the majority of representative experts in the CSM working group, Regulation 402/2013 does not modify the existing requirements on RAC.
Basically, Regulation 402/2013 clarifies the requirements for the independent assessment body referred to in Article 6 of Regulation N°352/2009. It defines the criteria to be fulfilled by the assessment body and the necessary requirements for accreditation or recognition of its competence necessary for the mutual recognition of the independent safety assessment report produced by the assessment body.
Regulation 402/2013 shall apply from 21 May 2015. In the meantime:
• The provisions of Regulation 352/2009 shall continue to apply until 21 May 2015.
• The Member States which decide to use the accreditation or recognition, or any combination of these two options, shall put in place the necessary provisions for the accreditation/recognition of assessment bodies.
